RULES FOR ENTRY

• In order to become a member of the exclusive KHW Honorable Charitable Members Membership, members must paya Nonrefundable fee of $3,000 plus tax (*)
• In order to become a member of the exclusive KHW Platinum Exclusive Membership, member must pay a Nonrefundable fee of $1,000 plus tax (*)
• In order to become a member of the exclusive KHW Purple Membership, member must pay a Nonrefundable fee of $750 plus tax (*)
• In order to become a member of the exclusive KHW Gold Membership, member must pay a Nonrefundable fee of $500 plus tax (*)
• In order to become a member of the exclusive KHW Silver Membership, member must pay a Nonrefundable fee of $300 plus tax (*)  ​
• In order to become a member of the exclusive KHW People’s Membership, member must pay a Nonrefundable fee of $150 plus tax (*)

(*) Membership is annual and is good for one year to the end of the month.

SHIPPING

You must be 21 years of age or older to order or receive alcoholic beverages from Kieu Hoang Winery. Receipt of shipments containing alcoholic beverages requires the signature of an adult. Wines purchased from Kieu Hoang Winery are not for resale and are for personal consumption only.

Kieu Hoang Winery obeys the laws of each state regarding shipment of wine direct to consumers. Due to legal restrictions on shipments of wine and other alcoholic beverages, we are only permitted to ship to the states Kieu Hoang Winery is compliant within the United States and the following countries:

Additional charges will apply for returned or re-shipped packages.

SHIPPING METHODS & COSTS

Domestic orders are shipped Monday through Thursday. International orders are shipped Monday through Wednesday.  Expect both domestic and international orders to take 2 to seven  business days to process and ship.

Wine shipments require a signature, at the time of delivery, from someone 21 years or older. No wine will be delivered to a visibly intoxicated person, and any person unable to produce age verification forfeits his or her right to receive the shipment until identification is produced. In such circumstances, the order may be held in storage at a local depot until appropriate identification is produced, or it may be shipped back to Kieu Hoang Winery

We are not responsible for duties and taxes in countries outside the United States. Please make sure you know the custom fees for your country before ordering.

All costs associated with the return of wine or other products to Kieu Hoang Winery due to unsuccessful delivery attempts will be charged to the customer. In the unlikely event of damage in transit, customers are responsible for filing claims directly with the appropriate third party transit carrier (UPS or FedEx.)

Shipping charges include costs for third party transit and all product-handling costs. Orders are processed following credit card authorization and are shipped weather permitting.  We will not release wine for shipment during weather extremes.  Instead the shipment will be held until conditions are suitable for the transit of wine.

Shipping Addresses – A street address is required for all shipments. We cannot ship to: P.O. Boxes, APO addresses, Hospitals, Military Bases, Colleges, Cruise Ships and Hotels.

Errors and Omissions – We are not responsible for typographical errors of any kind. There may be errors/omissions in listed prices, quantities, vintages and label or bottle images.  We reserve the right to adjust listed prices at our discretion, without prior notice.  The listing of a price for any wine on this Web site is not an offer to sell that wine, but rather is a solicitation for an offer from you, the consumer, to purchase that particular wine.  A contract regarding that particular wine is not formed until the Kieu Hoang Winery accepts your offer to purchase same.

Shipping Rates and Methods – Exact shipping rates for your entire order will be shown to you in the shopping cart prior to checkout. Certain states have restrictions on the quantity of bottles that can be ordered. We strictly adhere to the state liquor authority laws.  We will notify you if your order cannot be fulfilled due to a restriction.  If for any reason there are delays longer than this, we will notify you immediately via email.

Storage – If you are aware of an extreme hot or cold spell in your area, please notify us if you wish to delay shipment until the weather is more favorable. If your area is experiencing extreme weather conditions, the Kieu Hoang Winery can briefly hold your order for future shipment up – to 30 days maximum.  We are a high volume wine retail store; not a wine storage facility – our warehouse space is very limited. Orders that exceed the 30 day holding period are subject to a storage fee assessed solely at our discretion, and our liability in such cases is limited to the original transaction price.

ORDER CONFIRMATIONS

Once an order has been placed online, Kieu Hoang Winery will send an order confirmation via email to the email address associated with your membership account. When the order has been processed and shipped a second email will be sent with order tracking information to the email address associated with the shipping address.

RETURN POLICY

(*) Membership fee is renewed on an annual basis and it’s a nonrefundable fee; good for one year to the end of the month.

Shorted, Incorrect or Damaged Products – All claims for shorted, incorrect or damaged product must be made within 30 days of receipt of delivery. Returns due to any other reason will be at the purchaser’s expense and are subject to a 25% restocking fee.

Kieu Hoang Wine is not responsible for, and will not replace, wine that is damaged by extreme weather conditions during shipment. When the common carrier takes possession of your wine order, responsibility for the wine transfers to the purchaser.

Notice – Title to all wine purchases passes immediately to the purchaser at our premises in Napa, California at the time of purchase. You shall pay any applicable state and local taxes, and any applicable compensating use tax of another state which we may be required by law to collect at the time of the payment of the purchase price. We make no representation to the legal rights of anyone to ship or import any wines into any state outside of California. The buyer is solely responsible for shipment of wines.  By placing an order, you authorize us to act on your behalf to engage a common carrier to deliver your order to you.  Alcoholic beverages may be sold and delivered only to persons who are at least 21 years old.  In placing your order, you represent to us that you are at least 21 years old and the person to whom delivery will be made is at least 21 years old.  When your wine is delivered, ID will be required.

Terms and Conditions – All wine is sold “AS-IS,” without any representations or warranties, express or implied, including, but not limited to, as to merchant-ability, fitness for a particular purpose or other description of physical condition.

General – This Agreement shall be governed in all respects by the laws of the State of California, County of Napa. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. You agree that this Agreement and all incorporated agreements may be automatically assigned by the Kieu Hoang Winery, in our sole discretion, to a third party in the event of a merger or acquisition.  This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
